Not As was Hoped for, GNPF Push Judge to Decide On a 5 Year Sentence
JAKARTA ( Jurnalislam.com) – The advocacy team of GNPF MUI, Nasrulloh Nasution will support, the attitude and independence of the panel of judges to impose a five-year sentence on the defendant against the blasphemy of Ahok.
“Although the Public Prosecutor and the Legal Counsel agree Ahok does not commit a criminal act of defamation of Islam as Article 156a letter a of the Criminal Code, but the Judge must have his own record and analysis in deciding the case,” Nasrulloh Nasution said at the Ministry of Building, Ragunan, Jakarta, Tuesday (4/25/2017).
“We believe the Judge should dare to impose a 5-year imprisonment,” he added.
The imposition of 5 years imprisonment according to Nasrulloh is very reasonable. Because, based on the results of examination of evidence revealed the fact of Ahok’s actions repeatedly slandered Surat Al Maidah 51 and this according to him has fulfilled the requirements of the crime of defamation of religion as the First Alternative Count of Article 156a letter a of the Criminal Code.
Plus, he said, with the views and religious attitudes of the Indonesian Council of Ulama has judged as proof that reinforces the element of article 156a letter a of the Criminal Code, which clearly mentions Ahok has slandered Islam.
Therefore, following the reading of the decision on May 9, 2017, Nasrulloh and the team will soon deliver a letter of support to the Judge containing some jurisprudence related to religious defamation cases that have punished imprisonment to the perpetrators.
Not only that, he will also convey SEMA No.11 of 1964 which contains the Supreme Court’s instruction to severely punish the perpetrators of religious contempt because religion is an essential element for spiritual education.
“We support the judge to uphold the law and justice by declaring Ahok guilty of committing a criminal act of defaming religion Article 156a letter a of the Criminal Code with a sentence of 5 years in prison,” he concluded.
